The defendant having been indicted, tried and convicted of murder in the first degree on June 8, 1918, the case is before this court on exceptions to rulings at the trial allowed January 9, 1922, and exceptions, allowed on December 21, 1921, to the refusal to give certain rulings on a motion for a new trial *429because of newly discovered evidence, which was denied on June 29, 1920.
