Plaintiffs, individually and on behalf of all others similarly situated, assert that Defendant Barnes & Noble, Inc. violated the Fair Labor Standards Act, 29 U.S.C. §§ 201 et seq., by failing to compensate its Café Managers (“CMs”) for hours worked in excess of forty hours per week. Plaintiffs now move for conditional certification of their FLSA claims as a collective action and for leave to disseminate notice to the putative FLSA collective, pursuant to 29 U.S.C. § 216(b).
