Figueroa v. State
District Court of Appeal of Florida
1Opinion of the Court
NORTHCUTT, Judge.
The State charged Jose Figueroa with failing to register as a sexual offender pursuant to section 943.0435(4)(a), Florida Statutes (2010), and a jury convicted him of that crime. He contends that the evidence did not support his conviction because that subsection applies only to an offender who changes his residence within the State of Florida, not to an offender who moves to another jurisdiction. We conclude that the trial court should have granted Figueroa’s motion for judgment of acquittal on this point, and therefore we reverse and remand with directions to discharge him.
