Mabry, J.:

This is an appeal from a decree sustaining a demurrer - to an amended bill filed in the Orange County Circuit Court by appellant. The allegations of the amended bill are in substance that the complainant therein, appellant here, on the 4th day of Jane, 1886, jointly executed a note -with defendant J. II. Livingston, at *379Ms request, to the order of the First National Bank of Orlando in the sum of $1,681.85, but that complainant was in fact a mere surety on the note for the said Livingston; that on the 28th day of October following said note with the accrued interest thereon was…
