MaRSTON, J:

Plaintiffs in error brought ejectment to recover possession of certain lands, claiming title thereto under an administrator’s deed.

From the petition filed December 20, 1854, in the probate court of Wayne county, it appears that Thomas Scott died November 14, 1854; that immediately previous to his death he was an inhabitant of Wayne count}', and was possessed of personal property in said county to be administered.
