This was a. suit brought by appellee against appellant in the form of trespass to try titlé to section 9, block 3, Texas & New Orleans Railroad Company survey in Angelina county, Tex., but, in fact, the suit is one of boundary, the only question in the case being the true location of the west boundary line of the John Leonard' survey owned by appellant, the same being the east boundary line'of said section 9 owned by ap-pellee. The ease was tried before the court with the aid of a jury, but at the conclusion of the evidence the court instructed a verdict for appellee, which was…
