Appeal from, District Court, Greer County; T. P. Clay, Judge. A. W. Baldock was convicted of manslaughter in the second degree, and he appeals.

The plaintiff in error, A. W. Bal-dock, hereinafter called defendant, was informed against for the murder of E. T. Hurt, convicted of manslaughter in the second degree, and sentenced to serve six months' imprisonment in the county jail of Greer county at hard labor, and to pay a fine of $500.

To reverse the judgment rendered, he prosecutes this appeal.

The material undenied evidence is that Logan Pool worked in the Star cafe at Mangum, Okla., as a cook, and that on the 8th day of June, 1915, after supper, the defendant went to said restaurant and asked for Logan Pool, who at the time was in the…
