—The appellants are legatees and devisees under the will of John Hays, deceased, and the appellee is' the administrator, with the will annexed, of the estate of said Hays.

The record and finding of the court show the following state of facts:

On the 2d day of February, 1870, Hays executed his last will and testament. On the 6th day of March, 1871, he died testate. On the nth of the last named month, the *584will was admitted to probate by the clerk of the Hendricks Court of Common Pleas.
