Borden Worsham brought this action against Curtis Fields in which he alleged that he had contracted with Fields to remodel the bathroom and kitchen in his home for a fixed fee of $3,500. He contended that Fields had not performed the contract properly and that due to defective workmanship his house had been damaged in the sum of $2,097.96. Fields denied Worsham’s allegations and filed a “cross-action” for the remainder of the fee he contended was due under the construction contract.
