ORDER DENYING MOTION TO DISMISS COUNTS ONE AND TWO OF SUPERSEDING INDICTMENT

WARE, District Judge.

By grand jury indictment dated June 12, 1991, Defendant Vincent J. Di Girolamo (“Mr. Di Girolamo”) was charged with two counts of false statement on a tax return, 26 U.S.C. § 7206(1). The January 9, 1992 superseding indictment charged Mr. Di Girolamo with four counts, and Ellen A. Di Girolamo (“Mrs. Di Girolamo”) with two counts of false statement on a tax return, 26 U.S.C. § 7206.
