This is a suit for libel, by Fred Hervey, Mayor of the City of El Paso, against the Herald-Post Publishing Company, in the District Court of El Paso County, 34th Judicial District of Texas. The case was tried to a jury, which found that certain statements made in an article published in the El Paso Herald-Post, a newspaper owned by the Herald-Post Publishing Company, were not substantially true, that they were published and circulated by said paper with actual malice toward plaintiff, and that plaintiff was damaged thereby in the sum of $20,000…
