Judgment, Supreme Court, New York County (Leonard N. Cohen, J.), entered on or about May 10, 1989, which dismissed the petition brought pursuant to CPLR article 78 seeking reinstatement as a New York City police officer, is unanimously affirmed, without costs.

Petitioner resigned from his probationary position as a police officer when threatened with dismissal. The determination to terminate his employment was based upon a psychological evaluation, arising from incidents of bizarre behavior on March 16, 1988.
