The plaintiff in error, Willie Tucker, was convicted in the district court of Okmulgee county of stealing hogs, and was sentenced in accordance with the verdict of the jury to be imprisoned in the penitentiary for one year. The judgment and sentence was entered on March 21, 1911. An appeal was taken by filing in this court on September 14, 1911, a petition in error with transcript of the record attached. It appears from the record that upon the preliminary examination the following order was made by the committing magistrate:
