The town of Cicero having provided, by ordinance, for opening West Fifty-third street across appellant’s right of way, filed its petition in the Superior Court of Cook county for the ascertainment of the just compensation to be paid therefor, and for judgment of condemnation. The property is described in the petition as “a strip of land sixty-six feet in width across the right of way of the Chicago and Northwestern Railwajr Company there situate, included within the lines of said West Fifty-third street as proposed herein to be laid out, produced across said right of way.” The compensation…
