Plaintiff, as executor of the estate of Sarah A. Jory, deceased, alleges that the defendant on the 8th day of March, 1923, for value received, executed and delivered a promissory note payable to the decedent, Sarah A. Jory, in the sum of $240. Defendant answered, admitting the execution and delivery of the note, but alleging that, on the 8th day of March, 1924, the full amount due thereon was paid.
