MEMORANDUM DECISION AND ORDER

CONWAY, District Judge.

7. INTRODUCTION

The named plaintiff in this class action 1 is Richard Landow, next friend of his daughter, Kayla Landow, who is a member of the girls’ varsity softball team at Titus-ville High School. 2 Landow sues the School Board of Brevard County (“the School Board”), alleging disparities between girls’ softball and boys’ baseball programs at two high schools in Brevard County. 3 He claims that these disparities violate 20 U.S.C. § 1681 (“Title IX”) and Fla. Stat. § 228.2001 (“Florida Educational Equity Act”).
