RIPPLE, Circuit Judge.
This is an in rem action against the MTV Kalisti and an in personam action against the ship’s owner, Tomazos Shipping, Limited (“Tomazos”). The suit was brought by Dufereo Steel Incorporated (“Dufereo”), under the Carriage of Goods by Sea Act (“COG-SA”), 46 U.S.CApp. §§ 1300 et seq., to recover for damage done to goods in transit from Italy to the United States. The district court granted the motion of Tomazos to dismiss Duferco’s complaint. For the reasons set forth in this opinion, we affirm the judgment of the district court.
