ORDER

BUA, District Judge.

This order concerns the plaintiff’s motion pursuant to Fed.R.Civ.P. 23(b)(2) for class *946certification and the defendants’ motion to dismiss under Fed.R.Civ.P. 12(b)(6). For the reasons stated herein, the plaintiff’s motion for class certification is granted and the defendants’ motion to dismiss is denied.
