Defendant appeals from his plea-based convictions for delivery of marijuana, MCL 333.7401(1) and (2X0; MSA 14.15(7401X1) and (2)(c), and being an habitual offender, second offense, MCL 769.10; MSA 28.1082. Defendant was sentenced to three years probation with six months in jail.

Prior to pleading guilty, defendant moved to dismiss the charge on the grounds of entrapment. A hearing was conducted on February 6 and 7, 1984. At the end of these proceedings, the hearing was adjourned so defense counsel could present testimony of witnesses who were out of state at the time. When the entrapment…
