MEMORANDUM AND ORDER

HUYETT, District Judge.

Plaintiff May S. Fischman instituted the instant action against her former husband, Harry Fischman, and The Old Reading Brewery, Inc. (“Old Reading”) in the Court of Common Pleas of Philadelphia County. In her complaint plaintiff alleges that she is the promisee and holder of a note executed by Harry Fischman and endorsed by Old Reading. The note provided that Harry Fischman would make periodic payments of the principal sum to plaintiff.
