LIVINGSTON, Justice.
The appellant, Birmingham Electric Company, hereinafter called the “company”, is a corporation existing under the laws of the State of Alabama and is engaged in business as a public utility rendering electric, transportation and steam heating service to the public in the Birmingham district.
