Defendant was indicted for burglary in the second degree, sexual abuse in the first degree and sexual abuse in the third degree as the result of an August 28,1994 incident in which he *822entered a residence during the night, went into a woman’s bedroom and rubbed her upper thigh while she slept. During jury selection, defendant entered a counseled plea of guilty to the first two counts of the indictment with the understanding that he would be sentenced as a second felony offender to concurrent prison terms aggregating 5 to 10 years.
