¶ 1. A jury convicted Michael Baile of capital murder, and the circuit court sentenced him to life without parole in 2002. The facts of the crime are recounted in this Court’s opinion affirming the conviction of Balle’s co-defendant. Brink v. State, 888 So.2d 437, 441-42 (¶¶2-6) (Miss. Ct. App. 2004). 1 Baile did not file a direct appeal.
