This action was brought in the district court of Muskogee county by the state of Oklahoma, on relation of the Attorney General, defendant in error, as plaintiff, against W. S. White and Sophia McGuire White, plaintiffs in error, as defendants, on one promissory note for $1,000, and another for $600. Said notes were executed and delivered by defendants to the Union State Bank of Muskogee on June 6 and April 15, 1912, and due a few days thereafter, respectively. On September 15, 1913, the Bank Commissioner of Oklahoma adjudged said bank to be in an insolvent and failing…
