delivered the opinion of the court.
This is an action by appellee against appellant based upon paragraph 68 of chapter 114 of the Statutes, (Rev. Stat. 1903, page 1446) for the recovery of the value of live stock killed or crippled by one of the trains of appellant. Upon a trial by jury in the Circuit Court judgment was rendered against the defendant- for $1,315 damages and $150 attorney’s fees.
The section of the statute upon which the action is predicated is as follows:—
“That every railroad corporation shall, within six months after any part of its line is open…
