In this action the respondents, Galbraith, recovered against the appellant, Wheeler-Osgood Company, for the value of certain standing timber which was destroyed by fire.

The facts giving rise to the controversy are in substance these: The respondents own an 80-acre tract of land situated in Whatcom county. The appellant *230owns land abutting upon the east and south thereof. Prior to the year 1916, the lands were covered with timber.
