Appeal from a judgment of the Supreme Court (Lamont, J.), rendered May 28, 1999 in Albany County, upon a verdict convicting defendant of the crime of robbery in the first degree.
At approximately 4:15 a.m. on a Sunday in January 1998, defendant approached a convenience store which kept its doors locked, for security reasons, between the hours of 4:00 a.m. and 6:00 a.m., transacting business solely for requests concerning nonalcoholic products.
