This is an action in equity to enjoin 'the commissioner of water supply, gas and electricity of the city of New York and the water registrar of that department from cutting off, interfering with' or preventing plaintiff from receiving and enjoying water as it is now being had, used and enjoyed. Plaintiff is the owner of two large modern apartment houses at Seventy-second street and Riverside drive, in the city of New York, called the “ Ohatsworth ” and “ Ohatsworth Annex.” The former is some thirteen stories in height, with a frontage of about one hundred feet on Seventy-second street and…
