In a proceeding for leave to serve a late notice of claim, the Town of Huntington appeals, as limited by its brief, from so much of a judgment of the Supreme Court, Suffolk County (Brown, J.), dated August 16, 1990, as granted that branch of the petitioner’s application which was for leave to serve and file a late notice of claim pursuant to General Municipal Law § 50-e (5) upon it.

Ordered that the judgment is affirmed insofar as appealed from, with costs.
