I am convinced that defendant should be accorded a new trial because of the deception perpetrated by the *524juror Nelson as to his qualifications while under voir dire examination.
I doubt whether in the many decisions of this court there can be found one in which the court has made a more extreme exertion of power or one so little supported or explained either by the law or the record.
