W. H. Hoskins seeks relief here from a conviction of the crime of murder in the first degree, with a recommendation to the mercy of the court.

During- the progress of the trial, the defendant was *188introduced as a witness in his own behalf and testified that the deceased had made threats against him, the defendant, prior to the happening of the difficulty in which the deceased lost his life.
