The appellee was in the employ of the appellant as a conductor on a street-car running over the West Michigan street line in the city of Indianapolis. His employment began some time in the month of June, 1903, and continued • until August 3 of that year. Appellant’s West Michigan street line, over which the appellee’s car operated, extended from Blake street, in said city, to Haughville, a distance of perhaps two miles, and crossed White river.
