Adams, Judge.

Wayne Rasch appeals following his conviction on eighteen counts of securities violations and two counts of theft by taking. We affirm in part and reverse in part.

The state accused Rasch of operating a Ponzi scheme 1 over a four-year period. The evidence at trial showed that he induced a number of individuals to invest their money with his company with the promise of a high return. The charges in the case stem from transactions with six individuals.
