This is an action of trespass on the case in assumpsit brought by a broker to recover a commission. At the trial in the Superior Court the plaintiff was non-suited and the case is now before us on the plaintiff’s exception to the granting of the nonsuit and on exceptions to the admission and exclusion of testimony.
The declaration contains the common counts and two special counts in each of which the plaintiff alleges that the parties entered into an agreement whereby the plaintiff was given exclusive authority for a period of six months to sell the defendant’s drug stores, fixtures, leases,…
