BANKS, J.

The defendants were convicted under an indictment containing two counts. Both counts charged the defendants with the embezzlement of $4,239.53, the property of Mrs. Florence Lillie. The date of the embezzlement was alleged to have been July 2, 1930. The first count charged that the money was converted to the use of the defendant Leopold G. Blackman, and the second count charged that it was converted to the use of the defendant Harve Carter.
