Defendant was convicted in the Circuit Court of Mobile County of burglary in the first degree and rape and sentenced to imprisonment in the State penitentiary for life.

Appellant was indicted by the Grand Jury of Mobile County on April 14, 1971, for burglary in the first degree and rape. He interposed a plea of not guilty to the indictment and trial was held on June 8 and 9, 1971, in the Circuit Court of Mobile County.
