The plaintiff in error, Jess Cude, hereinafter referred to as defendant, was convicted in the district court of Canadian county of the crime of grand larceny, and sentenced to serve five years in the state penitentiary..
When the state rested, the defendant demurred to the evidence offered by the state, for the reason that it was wholly insufficient to sustain the verdict of guilty, which demurrer was by the court overruled.
