1Opinion of the Court

At the February, 1913, term of the court of common pleas of Morrow county, Ohio, an indictment was returned by the grand jury of said county against the plaintiff in error, John C. Morrow, for the crime of murder in the first degree. A motion to quash said indictment, and a demur*96rer thereto, were overruled, to which exceptions were taken. Thereupon the plaintiff in error entered a plea of not guilty to said indictment, and at said term of court he was put upon trial on said indictment and was convicted of the crime of murder in the second degree.
