FINDINGS OF FACT AND CONCLUSIONS OF LAW

KAZEN, District Judge.

This action challenges a certain procedure used by immigration inspectors at ports of entry within INS District Number 14. 1 The Plaintiffs contend that the procedure whereby these inspectors solicit and obtain waivers of exclusion hearings conflicts with the Immigration and Nationality Act, the Code of Federal Regulations and the fifth amendment to the United States Constitution.
