Appeal from St. Louis Circuit Court. This is a suit in equity to set aside a decree in favor of Butler county rendered at the July term of the circuit court of Butler county, in 1869, and to cancel certain deeds, and patents, among them a patent from said county to the St. Louis, Iron Mountain & Southern Railway Company, dated December 10, 1874, and to quiet the title to the lands mentioned in the decree and said several deeds and patents.
The lands in controversy are swamp lands and *622were conveyed by the secretary of the interior' to the .state under the act of congress of September 28, 1850 (9 U. S. Stats. at Large, p. 519).
