Appeal by the defendant, the F. C. Linde Company, from two judgments of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 14th day of November, 1899, upon the verdict of a jury rendered by direction of the court, and also from two orders entered in said clerk’s office on the 16th day of November, 1899, denying the defendant’s motions for a new trial made upon the minutes.

McLaughlin, J.:
On the 25th of March, 1899, the plaintiff, by an instrument in writing, bearing date on that day, leased to the defendant for the term of ten years and one month, commencing on the 1st of April, 1899, certain premises in the city of New York, at an annual rental of $12,000, payable quarterly, except the rent for the month of *287April, 1899, which was payable on the last day of that month. The defendant occupied the premises during, the month of April, 1899, but neglected and refused to pay the rent stipulated to be paid in the lease, and this action was brought to recover the same.
