MEMORANDUM AND ORDER
TROUTMAN, District Judge.
On October 26, 1970, the plaintiff filed in this Court a complaint alleging that on November 10, 1967, the defendant filed a declaration of taking under and pursuant to the provisions of the Pennsylvania Eminent Domain Code, condemning premises or property owned by the plaintiff in Haverford Township, Delaware County, Pennsylvania.
