MEMORANDUM OPINION AND ORDER

This cause is now before the Court on Plaintiffs Motion to Remand (Doc. # 21). This is the second time that this case has been removed to this Court. On the first attempt at removal, this Court remanded the case to state court. Since that time, however, the Class Action Fairness Act of 2005 (“CAFA”) came into effect. Defendants now argue that this Court has subject matter jurisdiction pursuant to CAFA.
