*449 NATURE OF CASE

Jeffery S. Smith appeals his convictions and sentences for first degree sexual assault of a child and felony child abuse following a bench trial in the district court for Harlan County. Smith claims that the court violated his constitutional right of confrontation when it allowed the alleged *450 victim to testify outside Smith's presence. Smith also makes claims of ineffective assistance of trial counsel, insufficiency of the **157 evidence, and excessive sentences. We affirm Smith's convictions and sentences.
