OPINION ON SUMMARY JUDGMENT

HUGHES, District Judge.

1. Introduction.

Murphy Roy, Jr., sued Sundowner Offshore Services, Inc., Shell Oil Company, (Shell) and Shell Offshore, Inc., (Shell Offshore) after he fell in a portable galley on an offshore platform. At the time of the accident Sundowner was an independent contractor for Shell Offshore. It was working on a well on a platform owned by Shell Offshore and located offshore Louisiana.
