— In an action, inter alia, to recover damages due to breach of a building loan agreement, (1) the plaintiff Fairview at Old Westfield, L.P. appeals from so much of an order of the Supreme Court, Nassau County (Saladino, J.), dated September 7, 1990, as granted the defendant’s motion to disqualify the plaintiffs’ law firm on the basis that an attorney from that law firm will likely be called as a witness to give necessary testimony in this action, and (2) the defendant cross-appeals from so much of the same order as denied that branch of its separate motion which was to strike the plaintiffs’…
