The facts in this case disclose that Harold A. Cowles was the owner of certain real estate in Cincinnati, Ohio, and that he and his wife, Vivian Christine Cowles,, borrowed $9,000 from the plaintiff herein, giving the plaintiff a note for the amount secured by a first mortgage (September 2, 1955). This mortgage contained a provision that the premises would be kept in good repair. The defendant Cowles later (October 6, 1956) executed an assignment of the note in favor of the plaintiff.
