ORDER DENYING MOTION TO DISMISS

The United States of America (“Government”) brought this suit under the Religious Land Use and Institutionalized Persons Act of 2000, 42 U.S.C. § 2000cc, et seq. (“RLUIPA”). The suit was filed in July of 2003 against the Maui Planning Commission, although it is probably more proper to have “Maui County” as the actual Defendant.
