Grice, Justice.
In the absence of proof that the plaintiff was in-possession, it was an essential part of his case to show at least prima facie that he owned the land the trespass on which he sought to enjoin. The answer denied the. averment of title. The plaintiff showed neither possession nor title; but insists that he was relieved of-the necessity of proving title since it was made to appear that he and the defendant claimed under a common grantor.
