In a negligence action to recover damages for personal injuries, defendant Nimmich appeals, as limited ,by his brief, from so much of an order of the Supreme Court, Nassau County, entered May 8, 1969, as granted plaintiff’s motion for summary judgment against said defendant, except with respect to the issue of damages. Order reversed insofar as appealed from, with $10 costs and disbursements, on the law, and plaintiff’s motion denied.
